On 11 February 2021, the Working Group of the Indian Association for Litigation Finance (“IALF”) convened virtually to sign the Founding Charter of the IALF and formally launch the organisation. The event also involved a panel discussion by the members of the Working Group on the topic of “Litigation Finance in India”. This is the last out of six parts of the recording of the panel discussion. In this part, the panelists answer questions from the audience about the future of the IALF, whether funders fund defenses or tax disputes, and whether and how funders would change their commercial approach when entering the Indian market. -

The event also involved a panel discussion by the members of the Working Group on the topic of “Litigation Finance in India”. This is the fifth out of six parts of the recording of the panel discussion. In this part, Mrs. Pallavi Bakhru (Partner, Grant Thornton India LLP) and Mr. Montek Mayal (Senior Managing Director, FTI Consulting) answer questions on how businesses perceive litigation finance, and what role a valuation expert plays in the process of obtaining litigation finance. -

The event also involved a panel discussion by the members of the Working Group on the topic of “Litigation Finance in India”. This is the fourth out of six parts of the recording of the panel discussion. In this part, Mr. Sharan Jagtiani (Senior Advocate, Bombay High Court), Mr. Shashank Garg (Partner, Advani & Co.) and Mr. Sameer Jain (Managing Partner, PSL Chambers) address how litigation finance can benefit the infrastructure sector, MSMEs, start-ups and companies undergoing insolvency. They also speak about how Indian judges would perceive litigation funding. -

In this part, Mr. Abhinav Bhushan (International Disputes Attorney, Singapore) talks about the importance of disclosure of litigation funding as a measure to prevent conflict of interest in arbitration, from the perspective of arbitral institutions. Funders also share their views on the subject. -

The event also involved a panel discussion by the members of the Working Group on the topic of “Litigation Finance in India”. This is the second out of six parts of the recording of the panel discussion. In this part, Mr. Tom Glasgow (Chief Investment Officer-Asia, Omni Bridgeway), Mr. Dilip Massand (CEO, Phoenix Advisors Ltd), Ms. Sindhu Sivakumar (Senior Investment Manager, Innsworth Capital), Mr. Alain Grec (Director and Head of Quantum Analysis, Profile Investment) answer questions on how funders approach litigation finance transactions. They discuss the benefits of litigation funding, funders’ perception of the Indian market, funders’ approach towards contingency fees and budgets, the amount of control funders’ exercise over disputes and the common reasons why funders reject a case for litigation funding. -
